     Catherine Wendel was born on 4 August 1782 at Shenandoah Co., VA. She was the daughter of Daniel Wendel and Mary Hawkins. Catherine Wendel married James Dryden on 6 December 1796 at Rockbridge Co., VA.

To the honourable the Judges of the High Court of Chancery
Humbly complaining shew unto your Honours your Orators Christopher
Windle and Abraham Smith, that they are in possession of a tract of
Land on the North Mountain being part of it contained in a survey
containing four thousand six hundred acres made on the said
mountain for Joist Hite & Co. and returned as one of the twenty-seven
surveys by Thomas Marshall and others in a suit in Chan
and other Complts against Fairfax and other defts -- Your Orators
further shew that they claim this Land under your Orator Christopher
and who about the year 1743 purchased from Joist Hite four hundred
acres part of the said Tract of 4600 acres for which your Orator
Christopher was to pay him three pound a hundred the greater
part of the price of which Land your Orator Christopher did
actually pay him as will more fully appear by the said Hites
receipt bearing date the 19th day of October 1743 hereto annexed
to which your Orators refer; which receipt is witnessed by John
Hite one of the Complainants. Your Orator further sheweth that in
consequence of the purchase aforesaid from the said Joist Hite your orator
Christopher was put into possession of the Land on which your Orators --
Christopher, John and Abraham live although your Orator Christopher
expressly charges that he never received his quantity of four hundred
acres to which he was entitled by his said Contract, and your Orator
Christopher admits that your Orators John and Abraham have a right
under him to the parts that each of them hold of the said Land.
Your Orators further shew that being possessed of only a part of the
Land which your Orator Christopher had thus bought from the said Joist
Hite and the said Hite and others Complts in the said suit which they
pray may be made deft to this their Bill, well knowing these
things they had hoped to remain undisturbed in their possession
thereof -- But now so it is may it please your Honours that the said
deft combining and confederating together have served your Orators
with a copy of the Decree made in the said suit and threaten to

turn them out of their possession. All which Actings and doings of the said
defts and their confederates are contrary to equity -- In tender consideration
whereof and for as much as your Orators are remediless except in this
Honourable Court. To the end therefore that the said defts particularly John
and Isaac may upon their Corporal oath true and distinct Answer
make to all and singular the premises as fully as if the same were
herein again repeated and interrogated to be answered unto, more
particularly that they may say whether they do not know or believe that
your Orator Christopher did make such contract with their father Joist
Hite as is set forth above and if not that contract what other and whether the
receipt hereto annexed is not ther father's writing and that the said
John Hite may say whether he was not a witness thereto, and whether
the money mentioned therein was not paid as the consideration for the
Land now in your Orator's possession, and if not for that Land for what
other Land? And that by a decree of this Honourable Court your Orators
may be quieted in their possession of the said Land, have their costs in this
expended, and such other and further relief as may be agreeable
in equity etc. May it please your Honours to grant to your Orators a writ
of Subpoena etc. and your Orators shall pray etc. etc.

John Hite believes that Christopher Windle the elder purchased some part
of the 4600 acre Tract in the Bill mentioned, and that he paid some
money on account thereof, but does not know the quantity of
the Land purchased or the amount of the money paid; that he may
have witnessed a receipt in 1743, but does not recollect it, nor
does he remember to have seen the receipt said to be annexed (end of p.2)

to the Bill; he does not know what quantity of Land the
said Christopher purchased, nor whether the Land in possession
of the Complainants is the same, nor does he know any thing
respecting the Title of the Complainants John and Abraham therefor.
He believes that the agreed price of the Land purchased by Christopher
Windle of the said Joist Hite has never been fully paid, because a
son of the said Christopher lately told him so -- and offered to pay him
the balance but did not mention the sum.

Andrew McKay knows nothing of the facts stated in the

Christopher Windal deposeth that Augustine Windal within the Year
of Our Lord 1737 entered upon a tract of Land which Philip Wendal this
deponant's father had had bought for him from Joist Hite, and this said
Hite in about three years after the above date came up with David Vance
a Surveyor and did lay off a Piece of Land the same where the said
Augustine Windal now lives about 130 Acres and that this deponant
had been at the said Hites the same time when he with the said Varner
went to lay off the same land for his Brother Augustine Windal and
the said Hite had told him so he being in said Hite's employ and that
the said Hite received four waggon wheels from the said Augustine
Windal in part of pay for his said land at ten shillings each wheel.

Christopher Windal deposeth that in the Year of our Lord 1737 he when coming
from the North and together with his father and Two Brothers call'd at the House
belonging to Joist Hite and stayed for about Two hours. The said Joist
Hite was then sitting at his door that this deponant's father Philip Windal asked the said
Joist Hite if his name was Joist Hite to which he answered Yes that was his
name Then the said Hite asked this deponant's father in his presence &
hearing where he came from and where he was going, and his father the said
Philip Windal made answer and saith he came from Pensylvania and was
going up as far as Old Jacob Funks and was hunting for Land, and the said
Joist Hite then saith that he had Land to sell near the said Jacob Funks, and if
they wou'd Stay a few days at the said Jacob Funks to rest their Horses, that
the said Windals might get some body to go with them and look some land where
they did like it and accordingly this deponant and his Two Brothers Valentine &
Augustine Windals together with the said Jacob Funk did go to look out
Land and came to that tract of Land cal'd the North Mountain tract which
they liked very well and the said Funk told them they might get it that nobody had
any Claim to it upon which we all returned back to the said Funks house and the
next day this deponant and his father the said Philip Windal and his Two Brothers
the said Valentine Windal and Augustine Windal moved with their wagg-
on and Baggage to the above said tract of Land and Erected a Cabin at the
Place where the said Valentine Windal now lives, and after they had Erected the
said Cabin the said Philip Windal went to the said Joist Hite and the said
Hite asked him how much land he was willing to take the said Philip told him
200 acres for his son Augustine Windal and the same quantity for his son
Valentine Windal and 400 acres for his son Christopher Windal and this depo-
nants father the said Philip Windal asked the said Joist Hite what he wou'd take
for the said land and he answered and said his price was three pounds per
hundred acres and further asked how soon it was to be paid and the said Hite
made answer and said he wou'd get the Land Survey'd & make them deeds for
the same as soon as he cou'd and then they shou'd Pay him for it and this
deponant further says that the said Hite was about building a mill &
Broke down his waggon wheels and meeting the said Philip Wendal at the
Chapel near where Stovers Town is now created and ask'd him for four of his wa-
ggon wheels which was granted and sent down and delivered to the said Hite by
the said Valentine Wendal in part pay towards the said Land at the
Rate of 10s. each wheels, and 4 waggon wheels more being deliver'd to the said
Hite by the said Augustine Wendal also in part pay toward the said
Land, and this deponant further says that in the fall of the Year of Our Lord 1737
came the said Joist Hite with the Surveyor Col. Wood and Jacob Newswoagger up
to the said tract of Land and did proceed to Lay off the said North Mountain tract
into Lotts and this deponant says he was Present and Seen the following lotts
Laid off. (viz) One lott for himself and One Lott for Ulrich Stoner One Lott for Thomas
Little. One Lott for George Sellers One Lott for Valentine Windal and One Lott
for one John Bauckman. And Two more Lotts which were not then Settled and this
Deponant further sayeth that he had improved his Lott at that time and that
Ulrich Stoner, Thomas Little and George Sellers and Valentine Wendal did then at
that time lived on their respective Lotts with their families.

Christopher Windle and Hiram Smith agst Hites and others. Chy.
The Bill states that they are in possession of part of the
Survey -- and that about the year 1743 Christopher Windle purchased of
Jost Hite 400 at £3 a hundred, the greater part of which was paid as
fo. Jost Hites rec. for £8.3.8 Cur. money, that he never got his full quantity of
400 acres.
The Defts answer, they believe Philip Windle did purchase
part of this survey, but how much or whether any part of the purchase money
was ever paid they know not, or whether the Land he purchased if he did purchase
is the same in the possession of the Compts, or whether it is in the possession of either
of the other Windles (the answer to Whose bills they refer) nor the price stipulated, or
and part has been paid -- that a son of s. Christopher offer'd to make a payment
to John Hite.

      Christopher Windle has a pro. Deed -- and now claims the Land under a
      purchase made by himself of Jost Hite so late as the year 1743 when the
      Rec. for £8.3.8 C.M. is dated . as Comm. books 1770 and also to support his
      claim under Hite produces as witnesses

Augustine Windle who says that his father Philip Windle purchased for Christopher
Interested          Windle at £3.00 a hundred and the money was to be paid when the deeds
               were made -- (and he claims land in this survey)

Valentine Windle says his father purchased of Jost Hite for Chr. Windle in 1737. This
Interested          deposition is copied from Christopher Windle's deposition in Valentine Windle's
               suit.


     Christopher Windle is a Witness for Augustine Windle and
     Valentine Windle who claim Land in this Survey --


It is supposed that Philip Windle did purchase some Land for his three
sons Christopher Winde, and Valentine Windle and Augustine Windle, and the Defts.
are willing they may have as much as is paid for ... the receipt which Christopher
now seems to want to support his claim, was certainly for his father ... no Land
was sold so late as 1743 ... some bonds have been given since, but such bonds were for
Land sold before 1743.

Val. Windle contradicts the statement in the bill.



( Decision of Chancery Court )

Virginia to Wit At High Court of Chancery held in Richmond Aug. 5th, 1790.
In the case of Christopher Windall, John Windall, and Abraham Smith in
possession of part of the four thousand and six hundred acres of Land called the
North Mountain tract, which part is stated to have been sold by Joist
Hite to Christopher Windall, under whom the other two possessions claim,
the sale by Joist Hite to Christopher Windall of the land whereon he
dwelled in the year one thousand seven hundred and forty-three, and
which was part of this North Mountain tract, being proven by the receipt
dated the nineteenth day of October in that year among the exhibits, and
the land to which he was entitled by the contract, having been granted
with other land to him by the lord proprietor, as appeareth by the report
of the commissioners, in the year one thousand seven hundred and
seventy, the Court is of Opinion that the possessors fall within the first
of the reservations, contained in the decree of the eighth of May in
the year one thousand seven hundred and eighty-six, be not carried into
execution as to so much, but that the possessors be quieted, and that the
plaintiffs in the principal Case, do pay unto them the Costs expended
by them on this Occasion, unless upon a survey, they shall be discovered
to hold more the land within the survey than the quantity to which this
decision affirmeth their title, in which Case the question as to Costs is
left open.

Christophel Wendel was born circa 1717 at Framersheim, Palatinate. He was the son of Johann Philip Wendel and Anna Margaretha Thiehl. Christophel Wendel immigrated on 17 August 1732 to Philadelphia, Philadelphia Co. (now), PA; Christophel is presumed to have immigrated with his father and two brothers on the Samuel in 1732 -- although only Augustine's name is clearly shown on the passengers list. He married Catherine Brumbach, daughter of Melchior Brombach and Maria Elisabetha Fischbach, in 1737 at Frederick Co., VA.¹ Christophel Wendel was naturalized on 5 May 1747 at Frederick Co., VA; Sacrament by Rev. Samuel Klug, Frederick Co., Virginia Order Book 2, page 238. Residence of 7 years in the Colony was required to receive this oath.² He lived on 23 July 1750, Granted 400 acres of land in Frederick County, VA.² He died between 27 February 1791 and 29 December 1791 at Toms Brook, Shenandoah Co., VA. He left a will on 27 February 1791 at Shenandoah Co., VA; Shenandoah Co., Va. Will Book "D" page 97:

Deed Book 112, page 61 Physical Description This two and one half story, L-shaped, log house with gabled, metal roof has two outside stone chimneys. The weatherboarding is wide and plain. The cornices are plain wood. There are sixteen windows with twelve 7x9 panes. There are two porches with square posts, and the back porch has a railing. The entrance is a plain six-panel, two-cross door. There are seven medium-sized rooms and the ceiling height is eight and one half feet. The concealed stairway is small and steep with batten door and iron latch. The doors are of three types; batten, with long iron bar hinge, also H-hinge; six-panel, two-cross; and two long vertical panels. The walls are plastered and whitewashed. There is a beaded chair rail. There are heavy iron hinges, H-hinges and long iron bar hinges. There are large locks and latches. The floors are of heavy boards ten to sixteen inches wide. From "Ancestry and Descendants of the Nassau-Siegen Immigrants to Virginia 1714 - 1750", page 77:

"Christopher Windle, Jr., third son of Christopher Windle and Catherine Brumback, was deeded land in 1775 by his father, which he sold in 1782 to his brother-in-law, John Huffman, as mentioned previously. He appears as a tithable in Shenandoah Co. only in 1782, and seems to have moved to Frederick Co., where he appears as head of a family with 1 tithable in 1787, 1789 and 1792 (in the two latter years as Christopher "Wingle", not Windle). His wife was named Susannah, and they seem to have had an unhappy marriage. On April 19, 1793 Christopher Windle and Susannah Windle of Frederick Co. entered into an agreement to separate; Susannah was to maintain their children, and for this purpose Christopher Windle transferred to Michael and Thomas Deaderick a bond from David Deaderick, also household goods, etc. (Frederick Co. Superior Court Deeds, No. 2, p. 20). One would judge from the above record that Susannah was born a Deaderick. Christopher himself seems to have moved back to Shenandoah Co., where he appears in the tithables of 1793 as "Christopher Windle (Sly Creek) 1 tithable." He is still shown in Shenandoah Co. in 1794 and 1795, but disappears after 1795."

But Four States Genealogist, Volume 1, Number 2, January 1969, Pulaski County, Arkansas; The Cantrells of Little Rock (p.62):
"The American ancestry of William Armour Cantrell, M.D. extends back through five generations from Dr. Cantrell to Stephen, Jr. to Stephen, Sr., to Joseph Zebulon, and finally to Richard Cantrell. Stephen Cantrell, Sr. was born in Abingdon, VA in 1758. He moved from NC to TN in 1776, at which time he was Captain of the Guard of the Continental Commissioners of NC. For his efforts and faithful performance of duty in this regard he was awarded a land grant of 640 acres on Stewart's Creek in Davidson Co, TN. In 1782, at Fort Blount, East Tennessee, Stephen Cantrell, Sr. met and later married, Mary S. Blakemore, the daughter of Major John Blakemore of the famous Donelson expedition. Stephen Cantrell, Sr. died at his home in Sumner County, TN, 2-5-1827, at the age of 68. His wife, Mary S. Blakemore, was born in NC on 3-8-1765 and died 8-2-1849, at the age of 84. Stephen Cantrell, Sr. & Mary S. Blakemore were the parents of 11 children, nine sons and two daughters. Their oldest child, Stephen Cantrell, Jr. was born 3-10-1783 in Sumner Co, TN and was married 1-2-1807 at Nashville, TN to Juliet Ann Deaderick Wendel. His occupations throughout life were many and varied. Merchant, Commissary & Quartermaster during the Creek War, Pension Agent for middle TN, County Magistrate, Mayor of Nashville, President of the Bank of Nashville, and finally a Cotton Planter on the Arkansas River, where he died of pneumonia on 9-5-1854, at the age of 71. Juliet Ann Deaderick Wendel, his wife, was born 4-8-1787, in Winchester, VA, the daughter of David Wendel, Sr. and Susanna Deaderick, his wife, Susanna Deaderick, the daughter of David Deaderick I and his wife, Rosanah Boucher, was also born in Winchester, Frederick Co, VA. David Diedrick, Sr. of Wurtemburg, Germany, emigrated to the US before 1750, and was among the German Pennsylvanians who settled Winchester, VA. Juliet Ann Deaderick Wendel's paternal grandfather was Samuel Wendel of Dort, Holland. David Wendel, her father, was a merchant of Murfreesboro, TN. Juliet, Mrs. Stephen Cantrell, Jr., was a niece of George M. Deaderick and a cousin of Judge David Deaderick, who was Chief Justice of TN. She died at Nashville, TN in 1840, at the age of 52. During the latter years of his life, Stephen Cantrell, Jr. resided near Pine Bluff, AR."

She married David Wendell; or Windle. Their children were: David Wendell, second, (who married Sarah Nielson); Rachell Wendell (who married J.P. Wiggins); Rosannah Wendell (who married Judge McLean); and Juliet Wendell , born January 2, 1803, Stephen Cantrell, Jr."

Christopher Wendel was born in 1745 at Frederick Co., VA. He was the son of Christophel Wendel and Catherine Brumbach. Christopher Wendel married Susannah Deaderick, daughter of David Deaderick and Rosannah Bucher, circa 1772 at Frederick Co. (probably), VA. Christopher Wendel died after 1795.

     Cora Elizabeth Wendel was born on 3 October 1875 at Marion Co., IA.¹ She was the daughter of Thomas Jefferson Wendel and Rebecca Pettit.¹ Cora Elizabeth Wendel married Elijah William Fortune, son of Peter B. David Wendel was born on 27 February 1774 at Shenandoah Co., VA, Birth and christening dates from Wayland's "History of Shenandoah County", Appendix p.739. He was the son of Philip Wendel and Elizabeth Dellinger. David Wendel was baptized on 10 April 1795 at St. Paul's Lutheran Church, Strasburg, Shenandoah Co., VA; page 231, St. Paul's church records. He lived in November 1850 at Shenandoah Co., VA, Living with younger brother Christian.¹ He died in March 1859 at age 85.

     Note: According to a short Memoir written by David Wendel, at the request of his son, he began his career on his own account as assistant in a store at Cheeks Cross Roads, near Morristown, in the year 1801. The owner of the store was Major W. Conway. David Wendel’s uncle, David Deadrick was a partner. After several years David Wendel stated that the business fell into his hands and he continued to run the store until his marriage in 1806. His bride was Sarah Hale Neilson, daughter of one of the early settlers in upper East Tennessee. Her grandfather, Hugh Neilson, had migrated from Glasgow, Scotland and settled in the county of Washington.
Four of the couple's children were born at Cheeks Cross Roads; Susan Juliet, John Franklin, Matilda Caroline and David Deaderick Wendel. After moving to Murfreesboro, David and Sarah Wendel added; James Edwy, Thomas Neilson, William Haney, Sarah Jane, Robert Searcy, Samuel Pitt, Benjamin Franklin, and Margaretta Deaderick Wendel to their family. This large family was to live and take an active part in the affairs of the city.
David Wendel expanded, what was originally a two room log cabin, into a large home for his family that was located on the west side of Spring Street midway between Main and College Streets. The original two rooms were built of hewn red cedar logs and the house was added to in subsequent years. When the house was razed in 1915, the cedar logs were purchased and reused to build another home in Murfreesboro. During the period of time Murfreesboro was capital of Tennessee, the legislature held some of its meetings in what later became the parlor of this house.
David Wendel’s obituary published in the Murfreesboro newspaper shortly after his death stated that David Wendel was a model of industry, methodical neatness, and punctuality, and a man of sound, highly cultivated judgment, and his honesty was above all suspicion. In the discharge of every duty, public and private, he was strictly conscientious, and was satisfied with the respect which this won, without seeking to form intimate friendships. David Wendel had accumulated an elegant library, and his leisure hours, surrounded by his family, were passed among his books. He endeavored from the earliest possible period, and unremittingly, to inspire his children with his own great love for reading.
David and Sarah Neilson Wendel are buried in the family plot in Evergreen Cemetery. This cemetery, founded before the Civil War, is the resting place of many notables of Murfreesboro; Carter Harrison, General Joseph B. Palmer, Congressman Charles Ready, Jr. Doctor J. B. Murfrees and Mary Noilles Murfree.

The first election Joshua Haskell was elected Mayor. Mayor Haskell resigned the following July and David Wendel was eleted at the annual election, Jan., 1819, but resigned the following April.

Sims) Page 40: A few changes worthy of mention was made in the government of the city of Murfreesboro between 1815 and 1860. In 1817, Murfreesboro was formerly incorporated. The Mayor and Alderman type of government was set up. The Aldermen were elected by popular vote and they, in turn, chose a Mayor. The first town officers were: Aldermen - Burrell Gannawayh, Nicholas Tilford, Thomas G. Watkins, William Barfield, Charles Niles and George A. Sublett. Burrell Gannaway was treasurer; William Ledbetter, recorder; and Benjamin Blankenship, town constable. Joshua Haskell was the first Mayor. He resigned before the end of the year, and was succeeded by David Wendel. Although the Charter was amended by the legislature from time to time; no important changes were made until after the Civil War, while the basic structure was not changed till the manager plan was adopted in 1921. It is interesting to note that the budget for Murfreesboro during the 1820's was between three hundred and four hundred dollars per year. In 1822, while Murfreesboro was the Capitol of the state, the Courthouse burned. The legislature was forced to meet in the Presbyterian Church. A commission consisting of David Wendel, John S. Jetton, Samuel P. Black, Benjamin McCollough, and John Hoover was appointed by the legislature for the purpose of supervising the erection of a new courthouse. The Commissioners were authorized to borrow six thousand dollars from the branch of the Nashville Bank at Murfreesboro.      David Deaderick Wendel was born on 4 February 1811 at Cheeks Crossroads, Hamblen Co., TN.¹ He was the son of David Wendel and Sarah Hale Neilson. David Deaderick Wendel was graduated in 1831 at University of Nashville, Nashville, Davidson Co., TN. He married Sarah Jane Keeble, daughter of Walter Blackhead Keeble and Sarah Jane Richardson Hudson, on 20 December 1837 at Rutherford Co., TN. Occupation: Merchant in Lexington, Tennessee for several years after graduating from the University of Nashville in 1831. He returned to Murfreesboro and engaged in farming until 1846 when he became Circuit Court Clerk, later Clerk of the Chancery Court. At the time of his death, he was cashier of the Stones River National Bank. For 32 years he was a ruling elder of the Murfreesboro Presbyterian Church. A tribute to David D. Wendel states that he and his wife, Sarah, were most estimable people, respected and beloved by all they intercourse with in society. They were true Christians of the Presbyterian faith. His character was unblemished, pure and upright, an honest man.¹ David Deaderick Wendel lived on 6 November 1850 at Murfreesboro, Rutherford Co., TN.¹ He died on 29 April 1873 at Murfreesboro, Rutherford Co., TN, at age 62. He was buried in 1873 at Evergreen Cemetery, Murfreesboro, Rutherford Co., TN.

Clark, son of James Archibald Clark and Cynthia Ellen Fortune, on 17 August 1902 at Marion Co., IA. Della Ethel Wendel lived on 25 April 1910 at Liberty Twp., Warren Co., IA.² She and Ethan A. Clark were divorced before 1925; 1925 Iowa state census shows Ethan divorced, with Mildred and James in his household. Della Ethel Wendel died in 1958.
