Mr. Brockway was a life member of the Riverside lodge of Masons and of the Baptist church of that city.
Funeral services will be held at the Hall-Kelso mortuary at 3 o'clock Friday afternoon.

Henry J. Broening
Henry J. Broening, elder brother of former Mayor William F. Broening, died yesterday afternoon at his home, 3613 Hillsdale road, following a heart attack.

Mr. Broening, who despite his years remained active in his legal profession until late Monday, when he was stricken, was able to sit up yesterday morning and death came suddenly.

The son of the late Henry J. Broening, he was born in this city June 8, 1859, and, after attending public schools, graduated from the University of Maryland Law School. He became interested in the development of South Baltimore at an early age. He was one of the organizers and for many years secretary of the South Baltimore Business Men's Association. He was elected Clerk of the Criminal Court in 1897.

He was a member of the Masons and of the Elks.

He is survived by his widow, formerly Miss Althea Householder; a son, H. Lyman Broening, and two grandchildren, and another brother, J. Fred Broening.

He was buried in May 1940 at Woodlawn Cemetery, Woodlawn, Baltimore Co., MD.

SON CONTESTS WILL OF H. J. BROENING

Octogenarian Lawyer's Only Child Charges Fraud

Caveat proceedings contesting the will of his father, Henry J. Broening, were filed in the Orphans' Court by H. Lyman Broening. Hollywood Cameraman, and only child of the octogenarian lawyer.

Mr. Broening, a brother of the former Mayor William F. Broening, died May 10, leaving an estate that has been appraised at $35,375.04. Mr. Browning formerly had been active in politics, once serving an elective term as a court clerk.

His will, dated October 21, 1937, left his entire estate to his second wife, Mrs. Althea E. Broening, whom he had married a year before.

The caveat filed by the son through Harry O. Levin, attorney, contested the will on four main grounds -- undue influence, fraud, mental incapacity and improper execution of the will.

Mr. Broening lived in the 3600 block of Hillsdale road. That property had been left to his second wife along with the rest of his estate. The will revealed that an ante-nuptial agreement concerning their inheritance rights had been made before the second marriage, but that he desired the agreement to be disregarded in order to give the wife the entire estate. The will failed to even mention the son.
