Maj. James W. Brockway, the Recorder of Deeds, was married last evening to Miss Louisa May Emmert, the daughter of Mr. J. P. Emmert of this city. The ceremony was performed at the Fourth Baptist Church, corner Paulina and West Washington streets, by the Rev. Mr. Perrin, of Western Avenue Church. A large number of the friends of the bride and bridegroom were present to witness the happy event, the church being almost filled. There was no effort made by the high contracting parties in the shape of display, whether in dress or in the exhibition of gifts, but for all that they had a very pleasant greeting as they passed out of the church from hosts of friends. Mr. Brockway and his fair young bride left the city last evening for a brief sojourn in the South.

NOTE: James was first married to Mary A. Smith in 1864, who died in childbirth in 1875 leaving three children: Hugh Walter, Mary B., and a daughter who died shortly after her mother.

DEATH OF MAJ. JAMES W. BROCKWAY.

Old and Well Known Resident of Chicago Passes Away.

Maj. James W. Brockway, an old resident of Chicago and for two terms Recorder of Cook County, died at 11:15 o'clock Wednesday night at his home, No. 79 Park avenue, after an illness of several months. The funeral will take place at 9:45 o'clock tomorrow morning from the family residence to Mount Greenwood Cemetery. The Rev. Dr. C. Perren will officiate.

Maj. James w. Brockway was born nearly sixty years ago in Stockholm, St. Lawrence County, N.Y., of a military line of ancestry, his paternal grandfather having served under Washington in the Revolution, and two of his mother's uncles have been Colonels in the War of 1812. His youth was passed on a farm. In 1856 he came West and entered the employ of the Michigan Central railroad, building elevators. He came to Chicago in 1858 and was in the building trade until 1860, when he went to Michigan to follow the same business. He returned to Chicago in 1862, and Aug. 15 of the same year enlisted in Elgin Battery, Illinois Light Artillery, serving in that command until 1864, when he was discharged for promotion. He was made Captain in the Twenty-ninth Regiment of colored troops, and lost a leg at the battle of Petersburg in the charge on Seminary Hill. The officers and men of his regiment testified under signature to his bravery in planting a flag on the enemy's works after he was wounded.

Maj. Brockway, on the recommendation of Gen. Grant and Gen. Weitzel, was then placed in command of the United States Hospital at Albany, N.Y. He came back to Chicago in 1869 and went into business again. In 1876 he was elected County Recorder on the Republican ticket, and was re-elected four years later. He was one of the organizers of the Chicago Gas-Light and Fuel company, of which he was elected director and President. In 1884 he went into the real estate business. A year later he became a partner in the restaurant firm of Brockway & Milan, subsequently Brockway & McKey. He retired from active business a year ago.

Maj. Brockway was active in organizing Gen. Godfrey Weitzel Post, No. 425, G.A. R., and gave it its name in remembrance of the kindness shown him by Gen. Weitzel in passing him through the lines and lending him an escort and ambulance when he was wounded.

Maj. Brockway married Miss Mary A. Smith in 1864. She was the daughter of John Smith, and old settler, and died in 1875, leaving three children, Hugh Walter, Mary B., and an infant daughter who soon followed her mother. His second wife was Miss Louise Emmert of Carroll County, who with her son, Louis Shaffner Brockway, is still living. The daughter of the first marriage is Mrs. George Cornish, wife of Prof. Cornish of McGill University, Montreal. She will arrive here today to attend the funeral.

     John Brockway married Alida Martin. John Brockway was born circa 1850 at Ohio.

     Louis Shaffner Brockway was born on 15 January 1881 at Chicago, Cook Co., IL.¹ He was the son of James W. Brockway and Louisa J. M. Emmert. Louis Shaffner Brockway married Lillian Madeline Johnson, daughter of Charles Johnson and Mathilda (?), on 25 June 1902 at Chicago, Cook Co., IL. Louis Shaffner Brockway lived on 20 April 1910 at 2204 Monroe Street, Chicago, Cook Co., IL, with his mother and grandmother Emmert, boarding in the Charles A. Allen household, married for 7 years (no wife listed), clerk in an office.² He married Ethelyn McGarvey on 15 November 1915 at Jackson Co., MO, ceremony by Rev. Elmore Sinclair, Jackson Avenue Christian Church. Louis Shaffner Brockway married Vita Claire Luce circa 21 January 1921 at Oklahoma City, Oklahoma Co., OK, license date. Vita was first married to Benjamin F. Willis in 1904 and had children John, Helen, and Howard. Louis Shaffner Brockway lived on 4 April 1930 at Louisville, Jefferson Co., KY, salesman, property insurance.³

     Bertha Marie Broening was born on 12 August 1891 at Lincoln, Lancaster Co., NE. She married Carl Ludwig Retzlaff, son of Frederick W. Retzlaff and Clara Louise Faulhaber, on 25 February 1920. Bertha Marie Broening died on 17 December 1956 at age 65. She was buried on 20 December 1956 at Trinity Lutheran Church Cemetery, Walton, Lancaster Co., NE.

     Henry Jacob Broening Jr. was born on 8 June 1859 at Baltimore, MD. He married Althea Elizabeth Franklin, daughter of Charles Samuel Franklin and Sarah Elizabeth Shipley, circa October 1936, Henry was first married to Carolyn Jean Lyman. They were separated by 1920 and divorced by 1930. They had a son, Henry Lyman Broening (1892 - 1983).

Henry J. Broening, elder brother of former Mayor William F. Broening, died yesterday afternoon at his home, 3613 Hillsdale road, following a heart attack.

Mr. Broening, who despite his years remained active in his legal profession until late Monday, when he was stricken, was able to sit up yesterday morning and death came suddenly.

The son of the late Henry J. Broening, he was born in this city June 8, 1859, and, after attending public schools, graduated from the University of Maryland Law School. He became interested in the development of South Baltimore at an early age. He was one of the organizers and for many years secretary of the South Baltimore Business Men's Association. He was elected Clerk of the Criminal Court in 1897.

He was a member of the Masons and of the Elks.

He is survived by his widow, formerly Miss Althea Householder; a son, H. Lyman Broening, and two grandchildren, and another brother, J. Fred Broening.

He was buried in May 1940 at Woodlawn Cemetery, Woodlawn, Baltimore Co., MD.

SON CONTESTS WILL OF H. J. BROENING

Octogenarian Lawyer's Only Child Charges Fraud

Caveat proceedings contesting the will of his father, Henry J. Broening, were filed in the Orphans' Court by H. Lyman Broening. Hollywood Cameraman, and only child of the octogenarian lawyer.

Mr. Broening, a brother of the former Mayor William F. Broening, died May 10, leaving an estate that has been appraised at $35,375.04. Mr. Browning formerly had been active in politics, once serving an elective term as a court clerk.

His will, dated October 21, 1937, left his entire estate to his second wife, Mrs. Althea E. Broening, whom he had married a year before.

The caveat filed by the son through Harry O. Levin, attorney, contested the will on four main grounds -- undue influence, fraud, mental incapacity and improper execution of the will.

Mr. Broening lived in the 3600 block of Hillsdale road. That property had been left to his second wife along with the rest of his estate. The will revealed that an ante-nuptial agreement concerning their inheritance rights had been made before the second marriage, but that he desired the agreement to be disregarded in order to give the wife the entire estate. The will failed to even mention the son.
